CSAV Germany Container Holding GmbH (“CGCH”) is a shipping investment company based in Germany. It is a principal shareholder in Hapag-Lloyd, holding a 30% ownership stake, and is party to a shareholder agreement that jointly controls over 70% of the company. As a result, CSAV Germany Container Holding GmbH exercises significant influence and joint control over Hapag-Lloyd.

Since 2014, our main business is container shipping through our stake in the German company Hapag-Lloyd AG, one of the world’s leading liner shipping companies.

Hapag-Lloyd, with a fleet of 299 modern container ships and a total transport capacity of 2.3 million TEU, is the world’s fifth-largest shipping line.

In the Liner Shipping segment, Hapag-Lloyd has around 14,000 employees and 397 offices in 139 countries. The company has a container capacity of 3.7 million TEU – including one of the largest and most modern fleets of reefer containers. A total of 113 liner services worldwide ensure fast and reliable connections between more than 600 ports on all the continents.

In the Terminal & Infrastructure segment, Hapag-Lloyd has equity stakes in 21 terminals in Europe, Latin America, the United States, India and North Africa. 2,900 employees are assigned to the Terminal & Infrastructure segment and provide complementary logistics services at selected locations in addition to the terminal activities.

The protection of personal data is highly important to CSAV Germany Container Holding GmbH, Ballindamm 27, 20095 Hamburg (“CGCH” or “we”). This Privacy Statement serves to inform visitors to the website of CGCH (“User” or “you”) about the processing of personal data (hereinafter “Data”) that takes place on the website of CGCH subject to the applicable data protection laws, in particular Regulation (EU 2016/679 (General Data Protection Regulation – “GDPR”).

1. Responsibility for data processing
CGCH is responsible for the lawful processing of the Users’ Data within the meaning of Article 4(7) GDPR.

2. Data processed and purposes of processing

2.1 Usage data
When the website of CGCH is accessed, the servers of CGCH automatically save various Data via the accessing system. This includes the type of browser used, the browser version, the operating system used, the website from which the website of CGCH is accessed, the controlled subpages of the website of CGCH, the date and time of access, the internet protocol address (IP address), the internet service provider and data comparable with such data.

CGCH uses these data to make the website accessible, to detect and remove possibly occurring technical problems and to prevent and, if need be, prosecute any abuse of the offering of CGCH. CGCH also uses these data in anonymized form, i.e. without being able to identify the User, for statistical purposes and in order to improve the websites. The legal basis for the processing of such usage data is Article 6(1)(f) GDPR.

2.3 Data processed in the course of contacting CGCH
CGCH’s website provides Users with the option of making contact with CGCH. The data transferred to CGCH in this connection (e.g. name, contact details, content of the enquiry) are exclusively used in order to handle the respective enquiries.

Should it be technically required in order to handle your request, your Data will be passed on to organizational units within CGCH. In doing so, we always check whether such transfer is necessary. All stored Data are deleted as soon as they are no longer needed for achieving the purpose for which they were collected.

The legal basis for processing the Data described above, depending on the reason why such contact is made, is Article 6(1)(b) GDPR where contact is made for contract-related reasons, respectively Article 6(1)(f) GDPR in all other cases.

2.4 Use of cookies
The websites of CGCH use cookies (“Cookies”). Cookies are small text files that are stored on the User’s data carrier and exchange certain settings and data with the system of CGCH via the browser. A Cookie normally contains the name of the domain from which the Cookie data are sent and information on the age of the Cookie and an alphanumerical identifier. Cookies enable CGCH to configure the website such that it appeals to the User and also facilitate usage by, for example, storing certain input such that it need not be entered anew. We only use essential Cookies. Essential Cookies are necessary to access and use our website and other features or content on the website that you wish to access or use. You can disable these Cookies, but this will make the operation of our website more difficult and may make certain features and services of our website unavailable to you. The legal basis for processing the Data contained in such Cookies is Article 6(1)(f) GDPR (legitimate interests).

3. Recipients of the Users’ Data
CGCH receives assistance from outside service providers for certain technical processing or storage processes and data analysis. These service providers are carefully selected and meet high data protection and data security standards. They are obliged to maintain strict confidentiality and process your Data only when commissioned to do so by us and according to our instructions. The legal basis for the involvement of these service providers is Article 28 GDPR.

Except in the cases set out in this Privacy Statement, CGCH only transfers Data to third parties without the
User’s explicit consent if CGCH is obliged or entitled to do so by law or by administrative or judicial directive.

4. Storage period
We will only retain your Data for as long as is necessary to fulfil the purposes for which we collected them, including for the purposes of satisfying any legal, accounting or reporting requirements. To determine the appropriate retention period for Data, we consider the amount, nature and sensitivity of the Data, the potential risk of harm from unauthorised use or disclosure of your Data, the purposes for which we process your Data and whether we can achieve those purposes by other means, as well as the applicable legal requirements. Usage data (see above) will be stored for a period of up to 24 months.

6. Rights of the Users
Users requiring detailed information on the processing of Data concerning them may contact CGCH (Article 15 GDPR). Should Users establish that the Data stored on them is incorrect or incomplete, they may require the rectification or completion of such Data (Article 16 GDPR). Subject to the preconditions set out in Articles 17 and 18 GDPR, the Users may also require the erasure or restriction of processing of their Data. In certain cases they may also ask to receive the Data they have provided to CGCH in a structured, commonly used and machine-readable format or for such Data to be transferred to a third party (Article 20 GDPR). Users also have the right to lodge a complaint with the competent supervisory authority.

Users finally have the right to object at any time, on grounds relating to their particular situation, to the processing of Data concerning them which is based on Article 6(1)(f) GDPR, including profiling based on these provisions (Article 21 GDPR). CGCH may no longer process the Data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the Users or for the assertion, exercise or defence of legal claims. Where Data are processed for direct marketing purposes, the User shall have the right to object at any time to the processing of Data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing.

7. Contact information
The User may contact CGCH at any time regarding questions concerning CGCH’s processing of Data and the exercise of rights to which the User is entitled against such processing. Notification to CGCH using the contact details stated at the beginning will suffice for this purpose.
